Today, the United States Supreme Court issued its ruling in the case of Bond v. United States. The unanimous judgment supports what disability advocates and legal scholars had long contended: that the Bond case is not an obstacle to ratifying the Disability Treaty. The coalition of over 800 disability, veteran, and faith organizations working in support of the Treaty today call on the Senate to proceed promptly to ratification of the Disability Treaty.

An international treaty on disabilities would not give the United Nations new powers over the United States or its citizens, former Senate Majority Leader Bill Frist and other advocates for the treaty said in trying to rally public support on the eve of a key Senate hearing. “This is our opportunity to boldly stand for the nearly 1 billion people worldwide living with a disability,” Frist, a Tennessee Republican and a surgeon, said in a recorded message that was played during a conference call organized Tuesday by the U.S. International Council on Disabilities. “The CRPD does not open up the U.S. to UN control. The CRPD is not a treaty that can create a legal cause of action or serve as a basis for a lawsuit.” The Senate is debating legislation that would have the United States sign on to the UN’s Convention on the Rights of Persons with Disabilities, which “would serve as a framework for creating legislation and policies around the world, modeled after the Americans with Disabilities Act,” the council said in a news release. About 130 nations have already signed on, former U.S. Rep. Tony Coelho said. The Senate rejected similar legislation last year, and U.S. Sen. Bob Corker of Tennessee was among the lawmakers who opposed it. Corker is the ranking Republican on the Senate Foreign Relations Committee, which will hold a hearing on the legislation today, Frist said. Angela Webster, a home-schooling parent and disability rights advocate from Erin, Tenn., said Corker now has an opportunity to help move the treaty forward. “His role is crucial,” Webster said. “I personally would love to see him take a second look.” Coelho, a former Democratic congressman from California who is now a lobbyist, said he had spoken to Corker. He said the senator “is aggressively trying to find the answers to his questions in order to be supportive.” Another former Senate majority leader, Bob Dole, the Republican nominee for president in 1996, also participated in the conference call. He urged the Senate to cast a “heavily bipartisan” vote in favor of the treaty, which “should have been done some time ago.”

Many Eastern European countries, people with disabilities are segregated in residential institutions, often for life. Those who live with their families are also frequently excluded from society due to a lack of community support. To help address this issue, the University of Delaware’s National Leadership Consortium on Developmental Disabilities (NLCDD) developed, in partnership with the Tizard Center at the University of Kent (UK), a two-part leadership development program in Budapest, Hungary called “Leading Change – From Institutional to Community Based Services for People with Mental Disabilities.”

Atlas Service Corps seeks nonprofit leaders from around the world to apply for a September 2011 Fellowship in the United States. Atlas Corps is an international network of nonprofit leaders and organizations that promotes innovation, cooperation, and solutions to address the world's 21st century challenges. The Atlas Corps Fellowship is a 12-month professional fellowship offered twice a year (March & September). Fellows serve at Host Organizations working on issues that complement their expertise. Fellows learn leadership skills while sharing best practices and supplement daily knowledge with theoretical topics presented in the Atlas Corps Nonprofit Management Series.

Nagase Osamu spoke before the Committee on the Rights at Persons with Disabilities that is convening in Geneva this week about his observations following the March earthquake, tsunami, and nuclear plant breakdown in Japan. Nagase Osamu, a member of the Inclusion International Council who is involved with Japan Inclusion, spoke on behalf of the International Disability Alliance.

FRA publishes Report on the right of persons with intellectual disabilities to political participation

This report provides the first results from a legal study carried out by the European Union Agency for Fundamental Rights (FRA) in the context of its project on the "Fundamental rights of persons with intellectual disabilities and persons with mental health problems". The report sets out by recalling the international and European standards favouring the full participation of persons with intellectual disabilities and persons with mental health problems in the electoral process. The comparative law analysis then highlights the diverse approaches adopted in the EU Member States. In a majority of these, persons who have lost their legal capacity are automatically deprived of their right to political participation.
